MA 02649 <br /> BOARD OF APPEALS <br /> I : <br /> DECISION <br /> FOR A VARIANCE <br /> ' Re: Petition of Bradford Wheatley for a Variance Case: V-88-09-O74A <br /> i <br /> A petition was filed by Bradford Wheatley of Mashpee, Massachusetts <br /> for a Variance for permission to build within 50 feet of the wetlands in <br /> an R-3 Zoning District on property located on Lot 11 Tide Run Way <br /> (map 125 - lot 253) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> r <br /> General Laws Chapter 4OA. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> September 28 and October 5, 1988, acopy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, October 12, 1988 at 7:30 p.m. at which time the following <br /> i <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Michael Makunas and Richard Halpern. <br /> The Board was informed that plans for the lot had been filed in 1974 <br /> prior to the ACEC act. He explained that the buildable land would be reduced <br /> 507 if the Applicant was required to stay within the ACEC and required <br /> setbacks. <br /> `t! The Board ascertained that due to the topography of the lot and the <br /> e A.C.E.C. line that a hardship was created. No comments were received <br /> from the. Conservation Commission. <br /> 1 Upon motion duly made and seconded the Board of Appeals voted unanimously <br /> �� on October 12, 1988 to grant a Variance to build within 50 feet of the wetlands. <br />
