BOX 1108 <br /> MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> t <br /> Re: Petition of Ellis and Phyllis Allen for a Special Permit Case.: SP-88-09-078 <br /> A petition was filed by Ellis and Phyllis Allen of Medfield, MA <br /> for a Special Permit under Section 5. 1 of the Zoning By-law for permission <br /> to relocate and enlarge a non-conforming structure in an R-3 zoning district <br /> on property located at 6 Jehu Pond Road (map 121, parcel 2) Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A- Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on <br /> September 28 and October 5, 1988, a copy of which is attached hereto and <br /> ` made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, October 12, at 7:30 P.M. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Michael Makunas and Richard Halpern.- <br /> The Board was informed that the applicants propose to relocate and <br /> enlarge one of three houses on the lot moving it further away from wetlands. <br /> The Board determined that this Special Permit request would be an <br /> improvement to the area. Upon motion duly made and seconded the Board of <br /> Appeals motioned unanimously on October 12, 1988 to grant the Special Permit <br /> to relocate and enlarge the southeasterly cottage and move it northerly per <br /> plan DWG.#ALLE396 dated 6/20/88 from All Cape Survey Consultant. <br /> The Board established that granting this Special Permit would be <br /> in harmony with the general purpose and intent of the ordinance or by-law, <br /> and would not be a detriment to the surrounding neighborhood. <br /> s <br />
