Lee for a Variance Case: V-88-09-081 <br /> A Petition was filed by Steven W. Zee of Mashpee, Massachusetts for a <br /> Variance under Section 7.4 of the Land Space Requirements for permission <br /> to vary the setback requirements in an R-5 zoning district on property <br /> +: located at 13 Redwood Circle (Map 27, Lot 119) Mashpee, Massachusetts. <br /> i Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on <br /> October 12 and October 19, 1988, a copy of which is attached hereto and made <br /> a part hereof. <br /> at A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, October 26, 1988 and continued on Wednesday, November 9, 1988 <br /> at 7:30 p.m. at which time the following members of the Board of Appeals <br /> were present and acting throughout: .William Hanrahan, Michael Makunas and <br /> Cheryl Hawver. <br /> Mr. Lee presented plans for a swimming pool to be built at the rear of <br /> the property on an irregularly shaped lot. He explained that a medical <br /> : hardship required use of the pool for therapeutic reasons. No abutters were <br /> present. - <br /> r <br /> The Board determined that due to circumstances related to the shape of <br /> the lot in question a literal enforcement of the provisions of the zoning <br /> by-law would involve substantial hardship. The Board found that this Variance <br /> request would not derogite from the intent or purpose of the By-laws and would <br /> not be a detriment to the surrounding neighborhood. <br /> Upon motion. duly made and seconded, the Board of Appeals voted unanimously <br /> on November 9, 1988 to grant a variance in side line setbacks of 3 feet <br /> reducing the requirement from 15 feet to 12 feet on each side of the pool <br /> and a variance in the rear setback requirement of 22 feet reducing the <br /> a <br /> setback from 40 feet to 18 feet. <br />
