BOX 1108
BLE cd" MASHPEE, MA 02649,
DECISION
FOR A SPECIAL PERMIT
Re: Petition of Ronald Ames for a Special Permit Case: SP-88-09-083
A Petition was filed by Ronald Ames of Mashpee for a Special
Permit under Section 5. 1 of the Zoning By-laws for permission to
change, intensify, extend or enlarge a pre-existing structure in
an R-3 zoning district located at 27 Bayview Road (Map 119, Lot 121)
Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the
Falmouth Enterprise, a newspaper of general circulation in the Town
of Mashpee, on October 12 and 19, 1988, a copy of which is attached
hereto and made a part hereof.
A public hearing was held on the petition at the Mashpee Town
Hall on Wednesday, October 26, 1988 at 7:30 p.m. at which time
the following members of the Board of Appeals were present and
acting throughout: Michael Makunas, Edward Govoni and Richard Halpern.
Attorney Robert Lawless, representing the Applicant, informed the
Board that the Applicant proposes to build a second story on a single
family home. Abutters present were in favor of the addition.
The Board determined that this Special Permit request is in
keeping with the neighborhood and would be an improvement.
Upon motion duly made and seconded the Board of Appeals motioned
unanimously on October 26, 1988 to grant the request for a Special
Permit to build the structure on a non-conforming lot and use
Holmes & McGrath plan 49-1-6 as a reference.
The Board established that granting this Special Permit would
beinharmony ,with the general purpose and intent of the ordinance
or by-law, and would not be a detriment to the surrounding neighborhood.
