Porciello, Jr. (Owner of record: A & M Realty Trust)SP-88-09-080 A Petition was filed by Vincent S. Porciello, Jr. of Hanover, Massachusetts for a Special Permit for permission to construct a walkway to an existing float in an R-3 zoning district on property located at 9 Tide Run Way (Map 126, Lot 37) Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in the Falmouth Enterprise, a newspaper of general circulation in the Town of Mashpee, on October 12 and October 19, 1988, a copy of which is attached hereto and made a part hereof. A public hearing was held on the petition at the Mashpee Town Hall on L Wednesday, October 26, 1988 at 7:30 p.m. at which time the following members • of the Board of Appeals were present and acting throughout: Michael Makunas, Richard Halpern and Edward Govoni. The Board was informed that the Applicant proposes to connect an existing walkway to an existing float with an aluminium ramp for seasonal use only. The Board determined that the ramp was a seasonal dock attached to an existing float and if permit was granted it would be conditional on an annual float permit. The Applicant had reviewed plans with the Conservation Commission, Shellfish Commission and the Harbormaster. There were no comments from abutters. .Upon motion duly made and seconded the Board of Appeals voted unanimously on October 26, 1988 to grant the Special Permit with the following conditions: 1. applicant must have a valid mooring permit each year 2. . the dock permit will expire upon the denial of a float permit 3. the dock and float will be stored off site in winter season 4. the applicant comply with all "Orders of Conditions" set forth by the Mashpee Conservation Commission.
