MA 02649 <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> A <br /> 'i Re: . Vincent S. Porciello, Jr. (Owner of record: A & M Realty Trust)SP-88-09-080 <br /> A Petition was filed by Vincent S. Porciello, Jr. of Hanover, Massachusetts <br /> for a Special Permit for permission to construct a walkway to an existing <br /> float in an R-3 zoning district on property located at 9 Tide Run Way (Map 126, <br /> Lot 37) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on October 12 and <br /> October 19, 1988, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> L <br /> Wednesday, October 26, 1988 at 7:30 p.m. at which time the following members <br /> • of the Board of Appeals were present and acting throughout: Michael Makunas, <br /> Richard Halpern and Edward Govoni. <br /> The Board was informed that the Applicant proposes to connect an existing <br /> walkway to an existing float with an aluminium ramp for seasonal use only. <br /> The Board determined that the ramp was a seasonal dock attached to an existing <br /> float and if permit was granted it would be conditional on an annual float <br /> permit. The Applicant had reviewed plans with the Conservation Commission, <br /> Shellfish Commission and the Harbormaster. There were no comments from abutters. <br /> .Upon motion duly made and seconded the Board of Appeals voted unanimously <br /> on October 26, 1988 to grant the Special Permit with the following conditions: <br /> 1. applicant must have a valid mooring permit each year <br /> 2. . the dock permit will expire upon the denial of a float permit <br /> 3. the dock and float will be stored off site in winter season <br /> 4. the applicant comply with all "Orders of Conditions" set forth by <br /> the Mashpee Conservation Commission. <br />
