Schmuhl for a Variance Case: V-88-10-089 <br /> A Petition was filed by Edward H. Schmuhl of Bedford, Massachusetts <br /> under Sections 7. 1 and 7.4 of the Land Space Requirements for permission to <br /> vary the side setback requirements in an R-3 zoning district on property <br /> located at 152 Whipporwill Circle (Map 125, Lot 142) Mashpee, Massachusetts. <br /> Notice was dulygivento abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a -newspaper of general circulation in the Town of Mashpee on <br /> October 26 and November 2, 1988. <br /> s <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, November 9, 1988 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Michael Makunas and Cheryl Hawver. <br /> Mr. Schmuhl presented plans showing the location of an above-ground pool <br /> which had been moved to the property from another location. He explained <br /> that the installer had placed the pool 12 feet from the side lot line rather <br /> than the 15 feet required. <br /> 4 The Board of Appeals, after carefully considering all of the facts and <br /> evidence submitted at the hearing, determined that the application form <br /> was incomplete and that the plans presented did not represent exact measurements <br /> of the property lines. <br /> Upon motion duly made and seconded the Board of Appeals motioned unanimously <br /> on November 30, 1988 to deny the petition without prejudice. <br />
