. afIIII of C,Litt$hJPP
BOARD OF APPEALS
P. 0. BOX 1108
f MASHPEE. MA 02649
DECISION
FOR A SPECIAL PERMIT
RE: Petition of Matilda T. Lizak for a Special Permit Case: SP-88-10-092
A Petition was filed by Matilda T. Lizak of Clifton Park, New York
for a Special Permit under Section 6.3.D. 1 and Section 6.3.E. 1 of the Land
Use Regulations for permission to build office and retail sales space in a
C-2 zoning district on property located at 486 Main St. Route 130 (Map 27,
Lot 123) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
z Enterprise, a newspaper of general circulation in the Town of Mashpee, on
October 26 and November 2, 1988.
A public hearing was held on the petition at the Mashpee Town Hall on
Wednesday, November 9, 1988 at 7:30 p.m. at which time the following members
of the Board of Appeals were present and acting throughout: William Hanrahan,
Michael Makunas and Edward Govoni.
George Benway represented the Petition. He reviewed the plans and said
that the Design Review Committee has approved the building and landscape plans.
The building is designed primarily for office space but the petition is
presented to include retail sales.
The Board determined that the use is in harmony with the general purpose
and intent of the zoning by-law and that the use complies with the general or
4
specific provisions set forth within the by-laws.
