MA 02649
DECISION
FOR A SPECIAL PERMIT
Re: Patricia Cronan for a Special Permit Case: SP-88-10-096
A Petition was filed by Patricia Cronan of Mashpee, Massachusetts
for a Special Permit for permission to expand a non-conforming structure in
an R-3 zoning district on property located at 155 Popponesset Island Road
(Map 112, Lot 13) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
• Enterprise, a newspaper of general circulation in the Town of Mashpee, on
November 16 and November 25, 1988, a copy of which is attached hereto and
made a part hereof.
- A public hearing was held on the petition at the Mashpee Town Hall on.
Wednesday, November 30, 1988 at 7:30 p.m.. at which time the following members
of the Board of Appeals were present and acting throughout: William Hanrahan,
Michael Makunas and Cheryl Hawver.
Attorney Kevin Kerraine represented the Applicant and presented plans
showing the proposed renovation and expansion of a non-conforming structure.
• He explained that the lot was thought to be in the New Seabury Special Permit
zoning but owners had discovered it was excluded.
The Board determined that the use is in harmony with other permitted uses
in this zoning district and a change or extension would not be substantially more
detrimental than the existing condition. Upon motion duly made and seconded
the Board of Appeals motioned unanimously on November 30, 1988 to grant the
Special Permit as requested. The Board established that granting this Special
Permit would be in harmony with the general purpose and intent of the ordinance
or by-law, and would not be a detriment to the surrounding neighborhood.
f
