MA 02649 <br /> DECISION <br /> FOR A VARIANCE <br /> Re: Petition of SHC, Inc. d/b/a Deer Crossing Market for a Variance <br /> Case: V-88-10-101 <br /> A Petition was filed by SHC, Inc. d/b/a Deer Crossing Market for a <br /> Variance under Sections 10.3.7 and 10.6.4 of the Sign By-laws for <br /> permission to continue the signage in a C-1 zoning district on property <br /> located at 681 Falmouth Road (Map 81, Lot 23) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on November 16 and November 23, 1988. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, November 30, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Michael Makunas and Cheryl Hawver. <br /> Attorney Kevin Kirrane represented the Applicant. He informed the <br /> Board that the store is primarily a convenience store but also sells <br /> malt beverages and the continued use of gaseous type signs in the windows <br /> is essential to the operation of his business. He withdrew the petition <br /> for a Variance from Section 10.6.4 to exceed 10% sign coverage on a <br /> window. <br /> The Board determined that the petitioner failed to meet the conditions <br /> c necessary for the granting of a Variance. The granting of this Variance <br /> would grant special privileges to the applicant not enjoyed by other property <br /> in the vicinity or the same zoning district. <br />
