MA 02649 DECISION FOR A VARIANCE Re: Petition of SHC, Inc. d/b/a Deer Crossing Market for a Variance Case: V-88-10-101 A Petition was filed by SHC, Inc. d/b/a Deer Crossing Market for a Variance under Sections 10.3.7 and 10.6.4 of the Sign By-laws for permission to continue the signage in a C-1 zoning district on property located at 681 Falmouth Road (Map 81, Lot 23) Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in the Falmouth Enterprise, a newspaper of general circulation in the Town of Mashpee, on November 16 and November 23, 1988. A public hearing was held on the petition at the Mashpee Town Hall on Wednesday, November 30, 1988 at 7:30 p.m. at which time the following members of the Board of Appeals were present and acting throughout: William Hanrahan, Michael Makunas and Cheryl Hawver. Attorney Kevin Kirrane represented the Applicant. He informed the Board that the store is primarily a convenience store but also sells malt beverages and the continued use of gaseous type signs in the windows is essential to the operation of his business. He withdrew the petition for a Variance from Section 10.6.4 to exceed 10% sign coverage on a window. The Board determined that the petitioner failed to meet the conditions c necessary for the granting of a Variance. The granting of this Variance would grant special privileges to the applicant not enjoyed by other property in the vicinity or the same zoning district.
