BOX 1108 <br /> A$ MASHPEE, MA 02649 <br /> DECISION <br /> ' OF NOTICE OF APPEAL <br /> RE: Appeal of James Kerrigan of Decision of Mashpee Building Department <br /> Case: NOA 88-10-102 <br /> An appeal was filed by James Kerrigan of Falmouth, Massachusetts <br /> from a decision of the Building Department to deny a building permit <br /> for the construction of a single family dwelling on a non-conforming <br /> lot in a C-2 zoning district on property located at 11 Lettie Lane <br /> (Map 36, Lot 47E) Mashpee, Massachusetts. <br /> Notice of the Applicant's appeal was duly given to abutters in <br /> accordance with Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on November 16 and November 23, 1988, <br /> a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, November 30, 1988 at which time the following members <br /> of the Board of Appeals were present and acting throughout: William <br /> Hanrahan, Cheryl Hawver and Michael Makunas. f' <br /> Counsel, representing the Applicant, presented plans of a six-lot <br /> subdivision approved in 1970 which included the lot in question. This <br /> d <br /> lot is now partially in a commercial zone although it was originally <br /> cf <br /> zoned for residential use. The Applicant proposes to use it for <br /> residential use only. Access to the property is from Goodspeed Meetinghouse <br /> A Road, a private road. <br /> .R <br />
