MA 02649 <br /> DECISION <br /> r" FOR A SPECIAL PERMIT <br /> RE: Petition of Arnold Schindler for a Special Permit Case: SP-88-10-097 <br /> A Petition was filed by Arnold Schindler of Norwood, MA for a Special <br /> Permit under Section 5. 1 of the Zoning By-law for permission to expand <br /> ti <br /> a non-conforming structure by the addition of a garage, bedroom and pool <br /> area in an R-3 zoning district on property located at 31 Waterway (Map 105, <br /> Lot 192) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> IIGeneral Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> I,.. Enterprise, a newspaper of general circulation in the Town of Mashpee, on <br /> November 30 and December 7, 1988, a copy of which is attached hereto and <br /> 1\ made a part hereof. <br /> i ' <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, December 14, 1988 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: Cheryl Hawver, <br /> Richard Halpern and Edward Govoni. <br /> The Board was informed that the applicant proposes to add a garage at <br /> one side of the house and a bedroom on the opposite side and a pool in the <br /> rear yard. The property was thought to be in the New Seabury Special Permit <br /> zoning but owners had recently learned it was excluded. <br /> The Board determined that the use is in harmony with other permitted uses <br /> in this zoning district and a change or extension would not be substantially <br /> } more detrimental than the existing condition. <br />
