MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of Ronald Bernaducci for a Variance Case: V-88-10-098 <br /> A Petition was filed by Ronald Bernaducci of Mashpee, Massachusetts <br /> for a Variance under Section 7.4 of the Land Space Requirements for permission <br /> to construct a single family dwelling in an R-3 zoning district on property <br /> located at 25 Sand Dollar Lane (Map 105, Lot 89) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> November 30 and December 7, 1988, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petitim at the Mashpee Town Hall on <br /> Wednesday, December 14, 1988 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: Cheryl Hawver, <br /> Richard Halpern and Edward Govoni. . <br /> The Board was informed that the Applicant proposes to construct a dwelling <br /> and requires variances in the side line setbacks. The Board determined <br /> that the topography of the lot created a hardship and there are no alternative <br /> locations in which to place the building. The Board found that this variance <br /> request will not derogate from the intent of the By-laws and would not be <br /> a detriment to the surrounding neighborhood. <br />
