BOX 1108 <br /> 1}1g CA MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of John Daly for a Variance Case: V-88-11-107 <br /> A Petition was filed by John Daly of Bridgewater, Massachusetts for a <br /> 7 Variance under Section 7.4 of the Land Space Requirements for permission <br /> to vary the set back requirements in an R-3 zoning district on property <br /> located at 3 Starboard Drive (Map 83, Lot 46) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> November 30 and December 7, 1988, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, December 14, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: Cheryl <br /> Hawver, Richard Halpern and Edward Govoni. <br /> The Board was informed that the Applicant proposes to build a 12' x <br /> 12' deck at the rear of his property. The lot is located at the corner <br /> of Spinnaker Drive and Starboard Lane and the house had to be set back <br /> 40 feet from each street. The Board determined that a literal enforcement <br /> of the by-law would create a hardship since there are unique circumstances <br /> relative to the shape of the land in question, but not affecting generally <br /> the zoning district in which the land is located. <br />
