Harris for a Special Permit Case: SP-88-09-073 <br /> A Petition was filed by George A. Harris of Mashpee, Massachusetts <br /> for a Special Permit for permission to expand a non-conforming structure <br /> for the addition of a 12' x 16' deck in an R-3 zoning district on <br /> property located at 41 Greenwood Road, Mashpee, MA. (Map 117, Lot 312) <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on September 14 and September 21, 1988, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, September 28, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Cheryl Hawver and Edward Govoni. <br /> The Board was informed that the applicant proposes to build a <br /> 12 foot by 16 foot wooden deck on the side of his property. <br /> The Board determined that the expansion of a non-conforming structure <br /> would not be substantially more detrimental to the neighborhood than the <br /> existing nonconforming use. Upon motion duly made and seconded the Board <br /> of Appeals motioned unanimously on September 28, 1988 to grant the <br /> Special Permit. <br /> The Board es.tablished that granting this Special Permit would be <br /> in harmony with the general purpose and intent of the ordinance or by-law. <br />
