Harris for a Special Permit Case: SP-88-09-073 A Petition was filed by George A. Harris of Mashpee, Massachusetts for a Special Permit for permission to expand a non-conforming structure for the addition of a 12' x 16' deck in an R-3 zoning district on property located at 41 Greenwood Road, Mashpee, MA. (Map 117, Lot 312) Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in the Falmouth Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 14 and September 21, 1988, a copy of which is attached hereto and made a part hereof. A public hearing was held on the petition at the Mashpee Town Hall on Wednesday, September 28, 1988 at 7:30 p.m. at which time the following members of the Board of Appeals were present and acting throughout: William Hanrahan, Cheryl Hawver and Edward Govoni. The Board was informed that the applicant proposes to build a 12 foot by 16 foot wooden deck on the side of his property. The Board determined that the expansion of a non-conforming structure would not be substantially more detrimental to the neighborhood than the existing nonconforming use. Upon motion duly made and seconded the Board of Appeals motioned unanimously on September 28, 1988 to grant the Special Permit. The Board es.tablished that granting this Special Permit would be in harmony with the general purpose and intent of the ordinance or by-law.
