BOX 1108 <br /> p h nBLE'� MASHPEE, MA 02649 <br /> 1 DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of David Hemingway for a Special Permit SP-88-07-054 <br /> A Petition was filed by David Hemingway of Wollaston, MA for a <br /> Special Permit under Section 5. 1 of the Zoning By-law for permission <br /> to replace and relocate a non-conforming structure in an R-3 zoning <br /> district on property located on Horseshoe Bend Way (Map 40, Lot 7) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on July 27, 1988 and August 3, 1988, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, August 10, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl Hawver, Richard Halpern, and Edward Govoni. <br /> The Board was informed that the applicant proposes to replace a <br /> summer cottage with a year round dwelling. The new structure will be <br /> placed further back from Ashumet Pond than the present cottage. <br /> The Board determined that the extension, alteration or change would <br /> be an improvement to the area. <br />
