l r,
O(Un of c ISh1PE
BOARD OF APPFrA,
P. O. BOX 1
h' eeZec'oMASHPEE. MA 02649
DECISION
FOR A VARIANCE
RE: Petition of Thomas Staruch and Robert F. Mills Case: V-88-06-051
A Petition was filed by Thomas Staruch and Robert F. Mills of Mashpee,
Massachusetts for Variance under Sections 7.1 and 7.5 of the Land Space
Requirements for the extension of a non-conforming use on property
located at Lot 40B Cotuit Road (Map 29, Lot 40) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on July 27 and August 3, 1988, a copy of which is attached hereto and
made a part hereof.
A public hearing was held on the petition at the Mashpee Town Hall on
Wednesday, August 10, 1988 at 7:30 p.m. at which time the following
members of the Board of Appeals were present and acting throughout:
Cheryl Hawver, Richard Halpern and Edward Govoni.
The Board was informed that the owners had purchased one lot on
Cotuit Road which contained two houses. They have received Planning
Board approval to divide the land into two lots. The house on Lot B
is in poor condition and the owners would like to have it demolished
and to rebuild on the lot. They are seeking the Variance to insure the
lot retains its buildability if the house is torn down.
Douglas Boyd, Building Inspector, and Randolph Peters, an abutter,
confirmed the deterioration of the structure.
The Board determined that there were circumstances which especially
affect the structure in question but which do not affect generally the
zoning district in which the structure is located. Due to these circumstances
the literal enforcement of the zoning by-law would create a hardship.
L
