Epstein for a Special Permit Case: SP-88-06-056
A Petition was filed by Gerald S. Epstein of Framingham, Massachusetts
for a Special Permit under Section 6.3.I.9 of the Land Use Requirements
for permission to construct and maintain a 16' x 8' float addition to an
existing pier on property located at Lot 45 Wheelhouse Lane (Map 120,
Lot 45) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on July 27 and August 3, 1988, a copy of which is attached hereto and made
a part hereof.
A public hearing was held on the petition at the Mashpee Town Hall
on Wednesday, August 10 at 7:30 p.m. at which time the following members
of the Board of Appeals were present and acting throughout: Cheryl Hawver,
Richard Halpern and Edward Govoni.
The Board was informed that the applicant's present dock is too
small for his boat and reviewed plans for the 16' x 8' addition.
The Shellfish Constable stated that the addition would not disturb
shellfish in the area.
The Board determined that the use is in harmony with the general purpose
and intent of the zoning by-laws and complies with the general provisions
set forth within the by-laws.
