Holmes) <br /> A Petition was filed by Mark Horan of West Yarmouth, Massachusetts <br /> for a Variance for permission to vary the 15 foot setback requirements <br /> from an ancient way in a R-3 Zoning District on property located on lot <br /> 92, Route 130 (map 37, parcel 15) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> February 10 & 17, 1988, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, February 24, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: Michael <br /> Makunas, Cheryl Hawver and Richard Halpern. <br /> The board ascertained that due to the shape of the lot there is no <br /> alternative location in which to place the dwelling. <br /> Upon motion duly made and seconded the Board of Appeals voted unani- <br /> mously on February 24, 1988 to grant permission to build within eleven <br /> feet of the ancient way (Pompeii Road) as requested. <br />
