MA 02649 <br /> DECISION <br /> RE: Petition of Margaret St. Claire Moore for a Variance Case #V-88-02-021 <br /> (owner of record; Margaret St. Claire Moore) <br /> A Petition was filed by Margaret St. Claire Moore of Mashpee, <br /> Massachusetts for a Variance for permission to vary the sideline setback <br /> requirements in a R-3 Zoning Distirct on property located on 30 Huron <br /> Avenue, (map 58, parcel 3) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> February 10 & 17, 1988, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, February 24, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: Michael <br /> Makunas, Cheryl Hawver and Richard Halpern. <br /> The Board was informed that the Applicant proposes to construct a <br /> 7' x 10' addition to the dwelling. Information was received that due to <br /> an engineering error the existing deck encroaches into the sideline set- <br /> back requirements. The Board ascertained that due to the entranceways of <br /> the dwelling there is no alternative location in which to construct the <br /> addition. <br />
