MA 02649
BOARD OF APPEALS
DECISION
FOR A SPECIAL PERMIT
A Petition was filed by Lloyd Gainsboro of Sharon, Massachusetts
for a Special Permit for permission to construct a stairway, pier,
gangway and float in an R-3 zoning district on property located at
59 Keel Way (Map 120, Block 139) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
Enterprise, a newspaper of general circulation in the Town of Mashpee
on March 27 and April 3, 1989, a copy of which is attached hereto and
made a part hereof.
A public hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, April 12, 1989 at 7:30 p.m. at which time the
following members of the Board of Appeals were present and acting throughout:
Cheryl A. Hawver, Michael A. Makunas and Edward M. Govoni.
Douglas Cameron of Braman Engineering represented the petition.
He presented plans for a 6' x 24' float to replace an existing float.
Both the Conservation Commission and the Shellfish Constable recommended
a reduction in the size of the float. Mr. Cameron agreed to review the
plans with Mr. Gainsboro.
New plans for a 6' x 20' float were presented at the May 10, 1989
meeting of the Board of Appeals. The Shellfish Constable had no
objections to the revised plan. No comments were received from abutters.
The Board established that granting this Special Permit would
be in harmony with the general purpose and intent of the ordinance or
by-laws and would not be a detriment to the surrounding neighborhood.
