This action is brought pursuant to Massachusetts <br /> General Laws Chapter 40A, section 17 , by the Plaintiffs who <br /> are persons aggrieved within the meaning of said Chapter , by <br /> the decision of the Zoning Board of Appeals for the Town of <br /> Mashpee dated February 1 , 1989 and recorded with the Town <br /> Clerk for the Town of Mashpee on February 2 , 1989 . Said <br /> decision constitutes a denial of the Plaintiff ' s request for <br /> an exception to permit the construction of a single family <br /> residential dwelling on a parcel located on Lettie Lane in the <br /> Town of Mashpee . The Plaintiffs seek to annul the decision of <br /> the Board of Appeals . Copy of decision attached hereto and <br /> made a part hereof . <br /> PARTIES <br /> 2 . The Plaintiff , James Kerrigan, is the trustee for the <br /> Meetinghouse Realty Trust , owner of the parcel of land which <br /> is the subject matter of the Board of Appeals ' decision and <br /> this appeal and is an aggrieved party within the meaning of <br /> Massachusetts General Laws Chapter 40A. <br /> 3 . The Plaintiff , Meetinghouse Realty Trust is the owner <br /> SMITH 6.CONNOLLY of the parcel of land which is the subject matter of the Board <br /> SUITE IC of Appeals ' decision and this appeal . <br /> 200 MAIN STREET <br /> P.O.ORAWERU 4 .
