This action is brought pursuant to Massachusetts General <br /> Laws Chapter 40A, Section 17 , by the Plaintiffs who are persons <br /> aggrieved within the meaning of said Chapter, by the decision of <br /> the Zoning Board of Appeals for the Town of Mashpee dated June <br /> 6 , 1989 and recorded with the Town Clerk for the Town of Mashpee <br /> on June 6, 1989. Said decision constitutes a denial of the <br /> Plaintiff ' s request for a Variance to permit the construction of <br /> a single family residential dwelling on a parcel located on <br /> Lettie Lane in the Town of Mashpee. The Plaintiff seeks to <br /> annul the decision of the Board of Appeals . Copy of decision <br /> attached hereto and made a part hereof . <br /> PARTIES <br /> 2 . The Plaintiff, James Curtis , is the trustee for the J. <br /> C. Realty Trust , owner of the parcel of land which is the <br /> subject matter of the Board of Appeals ' decision and this appeal <br /> and is an aggrieved party within the meaning of Massachusetts <br /> General Laws Chapter 40A. <br /> 3 . The Defendants , Cheryl A. Hawver, Michael A. Makunas and <br /> Richard E. Halpern are all members of the Mashpee Board of <br /> 6 CONNOLLY.P.C.
