MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: ' Petition of Drew Realty Trust for a Variance Case: V-89-03-32 <br /> A Petition was filed by Drew Realty Trust of Waltham, Massachusetts <br /> for a Variance for permission to vary the front line setback and lot <br /> coverage requirements and to build within the A.C.E.C. on property <br /> located in an R-3 Zoning.District at 19 Tide Run (Map 126, Block 4) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper ofgeneral circulation in the Town . <br /> of Mashpee on April 10 and April 17, 1989, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, April 26, 1989 at 7:30 p.m. and continued on Wednesday, <br /> May 10, 1989 at which times the following members of the Board of <br /> Appeals were present and acting throughout: William J. Hanrahan, <br /> . Cheryl A. Hawver and Richard E. Halpern. - - <br /> Attorney Kevin M. Kirrane represented the Petition. He presented <br /> plans for a single family dwelling which would be set back 25 feet from <br /> the street and result in 24. 1% lot coverage. He explained that the lot <br /> is now in the A.C.E.C. but was a buildable lot before the effective date <br /> of Section 11C of the Zoning By-laws. Comments were received from the <br /> Conservation Commission objecting to the location of the house as too <br /> close to the wetlands. <br /> The Board suggested a reduction in the size of the house. The hearing <br /> was continued on May 10, 1989 at which time Attorney Kirrane stated that <br /> the owner had modified the design of the house and lot coverage was now <br /> 20.6%. He reported that the Conservation Commission had requested that <br /> the house be moved back from the wetlands and front-yard setback was now <br /> 21' . - <br />
