MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Michael Scolavino for a Special Permit SP-89-03-37 <br /> A Petition was filed by Michael Scolavino of Mashpee, Massachusetts <br /> for permission to construct a dock in an R-3 zoning district on property <br /> located at 79 Seconsett Island Road (Map 119, Blocks 101 and 102) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on April 10 and April 17, 1989, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, April 26, 1989 and continued on May 10, 1989 at which <br /> time the following members of the Board of Appeals were present and <br /> acting throughout: William J. Hanrahan, Cheryl A. Hawver and Michael A. <br /> Makunas. <br /> Christopher Costa represented the petition. He presented plans for <br /> the repair of an existing bulkhead and dock and explained that new pilings <br /> would be installed with no change in size. The dock had been built <br /> 30 or 40 years ago. <br /> The Shellfish Constable stated that he had no objection to the <br /> repair of pre-existing docks. Mr. Costa said he expected minimal <br /> damage to shellfish and would possible put in new quohogs in the area. <br /> No comments were received from the Conservation Commission. <br /> The Board established that granting this Special Permit would be in <br /> harmony with the general purpose and intent of the ordinance or by-law <br /> and would not be a detriment to the surrounding neighborhood. <br />
