BOX 1108 <br /> ri)B MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of Karen Carroll for a Variance <br /> Case: V-89-03-35 <br /> A Petition was filed by Karen Carroll of Sherborn, Massachusetts <br /> for a Variance for permission to vary the restrictions of the Flood <br /> Plain Zone Provisions in an R-3 Zoning District on property located at <br /> 21 Squaws Lane (Map 117, Block 76) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> April 10 and April 17, 1989, a copy of which is attached and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, April 26, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William J. Hanrahan, Cheryl A. Hawver and Edward M. Govoni. <br /> The Board was informed that the applicant had done extensive <br /> remodelling to a 30-year old home and replaced the heating and hot <br /> water systems. The builder had not known the systems should have been <br /> moved to an upper floor until the work was completed. He now plans <br /> to build cement bunkers around the units. <br /> The Board determined that there would be substantial hardship in <br /> moving the utilities and that granting of the Variance would not result <br /> in increased flood heights or threats to public safety. The Board agreed <br /> to notify the applicant in writing that the actuarial rates may increase <br /> as the first floor elevation level increases risk to life and property. <br />
