MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of John Pastuszak for a Special Permit SP-89-03-40 <br /> A Petition was filed by John Pastuszak of Hingham, Massachusetts <br /> for a Special Permit for permission to construct a single-family <br /> residence in an R-3 Zoning District on property located at 7 Wilson's <br /> Grove (Map 118, Block 101) Mashpee, Massachusetts. (Legal lots 216, <br /> 218 and 220 on a subdivision plan 6811-D filed with Certificate of <br /> Title No. 578 and Lots IH, II, IJ, IK, IL, IM and 3B as shown on plan <br /> number 11408-S with Certificate of Title No. 6172.) <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on <br /> April 24 and May 1, 1989, a copy of which is attached hereto and made a <br /> part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, May 10, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William J. Hanrahan, Cheryl A. Hawver and Michael A. Makunas. <br /> Mr. Pastuszak presented plans of the lot and proposed plan of the <br /> house. The Board was informed that the lot is the largest in the area. <br /> He presented the Board with eight letters from abutters in favor of the <br /> Petition. There was no opposition from abutters. <br /> The Board determined that the use is in harmony with other permitted <br /> uses in this zoning district and a change or extension would not be a <br /> detriment to the surrounding neighborhood. The Board found that the <br /> Special Permit request will not derogate from the intent of the Zoning <br /> By-laws. <br />
