BOX 1108 <br /> P MASHPEE, MA 02649 <br /> RE: Petition of William Sullivan for a Variance <br /> Case: V-89-01-16 <br /> A Petition was filed on January 13, 1989 by William Sullivan <br /> of Providence, Rhode Island, for a Variance for permission to vary <br /> the front-line setback and permission to construct a pool within <br /> 50 feet of the wetlands in an R-3 zoning district on property located <br /> at 6 Daniel's Island Road (Map 100, Lot 18) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee on February 8 and February 15, 1989, a copy of which is <br /> attached and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, February 22, 1989 at 7:30 p.m, at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Michael A: Makunas and Richard E. <br /> Halpern. <br /> The Board was informed that the owners plan to expand a garage <br /> and improve access to it requiring a reduction in the front-line <br /> setback from the present 18' to 14' . They also propose to install a <br /> pool at the rear of the property. <br /> The Board determined that the shape of the lot created a <br /> hardship and there were no alternative locations to expand the <br /> garage. The Board found that this variance request will not <br /> derogate from the intent of the by-laws and would not be a <br /> detriment to the surrounding neighborhood. <br /> No comments were received from the Conservation Commission. <br />
