MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> Re: Maria and Mary Rita Krizik for a Special Permit SP-89-02-20 <br /> A Petition was filed by Kenneth Charlonne, Agent for Maria and <br /> Mary Rita Krizik, of Forestdale, Massachusetts for a Special Permit <br /> for permission to construct a guest apartment in an R-3 zoning district <br /> on property located at 17 Cedar St. (Map 77, Block 37) Mashpee, MA. <br /> Notice was duly .given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee on February 22 and March 11, 1989, a copy of which is <br /> attached hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 8, 1989 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and Edward M. Govoni. <br /> Mr. Charlonne presented plans of a proposed apartment to be built <br /> in the lower level of the house. The plans included living room, <br /> bedroom, bath and kitchen. No comments were received from abutters. <br /> Mr. Makunas questioned if the Petition met the requirements <br /> necessary for the granting of a Special Permit. He expressed the <br /> opinion that the conversion of the property to a two-family home in a <br /> single residential district would be a detriment to the neighborhood <br /> and would derogate from the intent of the Zoning By-laws. <br /> Mr. Makunas stated he would deny the Petition. <br /> Mr. Govoni moved to grant the Special Permit. Ms. Hawver seconded. <br /> The motion did not carry. <br />
