MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of William Zammer for a Special Permit <br /> CASE: SP-89-02-18 <br /> A Petition was. filed by William Zammer of Mashpee, Massachusetts <br /> for a Special Permit for permission to expand a non-conforming structure <br /> in an R-3 zoning district on property located at 10 Beach Road <br /> (Map 123, Lot 155) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A, Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on February 22 and March 1, 1989, a copy of which is attached hereto tiPECIA��" <br /> and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, March 8, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl Hawver, Michael Makunas and Richard Halpern. <br /> The Board was informed that the owner proposes to replace a <br /> summer cottage with a year-round home and add a second story. <br /> Abutters present voiced no objections. <br /> The Board determined that the use is in harmony with other <br /> permitted uses in this zoning district and the change or extension <br /> would not be substantially more detrimental than the existing <br /> condition. The Board established that the use complies with the <br /> provisions of the zoning by-laws and would not be a detriment to <br /> the surrounding neighborhood. <br />
