Orlando for a Variance V-89-09-88 <br /> A Petition was filed by Albert J. Orlando of Mashpee, Massachusetts <br /> for a Variance from Section 7.4 of the Land Space Requirements for <br /> permission to build a garage in an R-5 zoning district on property <br /> located at 240 Wheeler Road (Map 49, Block 28) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 9 and October 16, 1989, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, October 25, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Mr. Orlando represented his application. He presented plans for <br /> a garage which would result in a sideline setback of 5. 18' and explained <br /> that this was the only possible location due to the narrow width of the <br /> lot and the location of the septic system. No comments were received <br /> from abutters. <br /> The Board found that the topography of the lot created a harship <br /> and that this Variance request would not derogate from the intent of <br /> the By-laws and would not be a detriment to the surrounding neighborhood. <br />
