Orlando for a Variance V-89-09-88
A Petition was filed by Albert J. Orlando of Mashpee, Massachusetts
for a Variance from Section 7.4 of the Land Space Requirements for
permission to build a garage in an R-5 zoning district on property
located at 240 Wheeler Road (Map 49, Block 28) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on October 9 and October 16, 1989, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town Hall
on Wednesday, October 25, 1989 at 7:30 p.m. at which time the following
members of the Board of Appeals were present and acting throughout:
Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan.
Mr. Orlando represented his application. He presented plans for
a garage which would result in a sideline setback of 5. 18' and explained
that this was the only possible location due to the narrow width of the
lot and the location of the septic system. No comments were received
from abutters.
The Board found that the topography of the lot created a harship
and that this Variance request would not derogate from the intent of
the By-laws and would not be a detriment to the surrounding neighborhood.
