Arnold for a Special Permit SP-89-09-89 <br /> A Petition was filed by Jeffry L. Arnold of Mashpee, Massachusetts <br /> for a Special Permit for permission to change or extend a non-conforming <br /> structure in an R-3 zoning district on ;property located at 19 Bluff <br /> Avenue (Maplll, Block 146) Mashpee, MA. (Owner of record: Jeffry L. <br /> and Cynthia E. Arnold) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 23 and October 30, 1989, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> a <br /> on Wednesday, November 8, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Mr. Frank Peros represented the applicant. He informed the Board <br /> that Mr. Arnold proposed to replace a seasonal cottage with a year-round <br /> home. The existing structure has side set backs of 13' on one side <br /> and 18.5' on the other side. The Board informed Mr. Peros that the 13' <br /> set back was protected but that of a minimum of 15' would be required <br /> on the other side after the expansion. Mr. Peros presented revised plans <br /> which conformed to these requirements. No comments were received from <br /> abutters'. <br /> The Board determined that the use is in harmony with the general <br /> purpose and intent of the zoning by-laws and complies with the provisions <br /> of the by-laws. The Board further found that the extension would not <br /> be more detrimental to the neighborhood than the existing nonconforming. <br /> use. <br /> , <br />
