BEFORE THE MASHPEE ZONING BOARD OF APPEALS <br /> PETITION OF RICHARD AND MIRIAM COFFMAN <br /> FOR SPECIAL PERMIT OR VARIANCE <br /> MEMORANDUM IN SUPPORT OF THE PETITION <br /> I. INTRODUCTION. <br /> The petitioners, Richard and Miriam Coffman, seek <br /> permission from this Board to construct a small addition to <br /> their home at Lot 167 Whipporwill Circle. The petition is <br /> necessitated by Section 7.7 of the Zoning By-law, which <br /> requires a setback of 50 feet from wetlands as defined in <br /> M.G.L. c. 131 sec. 40. <br /> The lot is non-conforming ( undersized) , and further has <br /> pre-existing lawfully constructed structures located within <br /> the 50 foot setback limit mandated by Section 7.7. The <br /> Petitioners seek the grant of a Special Permit to enlarge or <br /> extend the non-conforming structure under Section 5 .1 and <br /> 6.2, or in the alternative , a variance from the requirements <br /> of Section 7 .7, <br /> IAM C.
