The project as proposed will have no adverse effect upon <br /> any of the natural resources of the Town, and will not be <br /> detrimental to the neighborhood. All work will be performed <br /> by hand on an already existing terrace area, with no <br /> alteration whatsoever to the estuary. No excavation is <br /> proposed other than the installation by hand of sona tube <br /> footings. A hay-bale work limit will be installed prior to <br /> the commencement of construction, in order to insure that the <br /> effects of construction stay within the limits shown on the <br /> plans . The proposed addition will not constitute a change in <br /> use, nor provide for a more intensive use of the existing <br /> home , and will not result in a detriment to the neighborhood. <br /> III . REQUEST FOR VARIANCE. <br /> If the Board should decide that it is not able to grant <br /> a special permit , the Petitioners respectfully ask that the <br /> Board vote to allow a variance from the provisions of Section <br /> 7.7 of the Zoning By-law, as the variance is required due to <br /> the unique shape and topography of the lot , which does not <br /> affect the zoning district as a whole . As set forth above , <br /> IAM C. HENCHY <br /> ORNEY AT LAW the proposed work will not cause any adverse effect upon the <br /> 6 MAIN STREET <br /> II NG'S HIGHWAY natural resources of the Town, and will not cause a <br /> O.BOX 945 <br /> ABLE.MA 02630 detrimental effect upon the neighborhood. The variance may <br /> 713629690 be granted without causing derogation to the public good , and <br /> will not detract from the general purposes of the By-law. <br />
