MA 02649 <br /> BOARD OF APPEALS <br /> SOUTHPORT RELEASE <br /> UNIT: <br /> j OWNER: <br /> WHEREAS, the Special Permit pertaining to the Southport <br /> �Project originally provided that certain amenities were to be <br /> completed before the issuance of the first Certificate of <br /> Occupancy; and <br /> WHEREAS, the Board of Appeals, at Petitioner's request, <br /> amended the Special Permit to permit issuance of Certificate of <br /> Occupancy even though not all the required facilities were <br /> complete; and <br /> WHEREAS, the Board of Appeals is willing to authorize <br /> issuance of Certificate of Occupancy upon the execution of a <br /> Release as hereinafter provided; <br /> NOW, THEREFORE, in consideration of the issuance of said <br /> Certificate of Occupancy, the undersigned owners for themselves, <br /> their heirs, successors and assigns, acknowledges that said required <br /> facilities are not at this time complete and hereby releases the <br /> Town of Mashpee from any liability arising out of said noncompletion. <br /> EXECUTED as a sealed instrument this day of <br /> 19 <br /> Owner <br /> See attached Modification of <br /> Special Permit SP-89-10-97 Owner <br />
