MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: William F. and Christine Mullen for a Variance V-89-10-98 <br /> A Petition was filed by William F. and Christine Mullen of <br /> Westwood, Massachusetts for a Variance for permission to vary the <br /> set back requirements in an R-3 zoning district on property located <br /> at 1 Lisa Lane (Map 99, Block 11) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on November 13 and November 20, 1989, a copy of which is attached <br /> hereto and made apart hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, November 29, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Michael A. Makunas, William J. Hanrahan and Richard E. Halpern. <br /> Ron McCarthy, Builder, represented the applicant. He explained <br /> that engineering errors had been made in 1982 when the property was <br /> built with the result that the side line set back from the garage is <br /> 14.41' .and the front set back from the pool is 23.76' . The errors. <br /> were recently discovered after an application for a mortgage. <br /> The Board determined that a literal enforcement of the provisions <br /> of the zoning by-laws would involve substantial hardship and that <br /> desireable relief could be granted without derogating from the intent <br /> of the by-laws. The Board found that this Variance request would not <br /> be a detriment to the surrounding neighborhood. <br />
