MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> iRE: Petition of Suzanne Nash for a Special Permit SP-89-11-105 <br /> 7 A Petition was filed by Suzanne Nash of Canton, Massachusetts <br /> for a Special Permit under Section 5. 1 of the Zoning By-laws for <br /> permission to expand a non-conforming structure with a building <br /> addition and deck in an R-5 zoning district on property located at <br /> 57 Timberlane Drive (Map 29, Block 33C) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on November 27 and December 4, 1989, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday. December 13, 1989 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Richard E. Halpern and Edward M. <br /> Govoni. <br /> George L. Thorng of Arrow Engineering represented the applicant. <br /> JHe informed the Board that the applicant, had received a Variance from <br /> the Board in October to allow building within fifty feet of Santuit <br /> Pond. He presented plans showing an addition to an existing dwelling <br /> and a new deck. No comments were received from abutters. <br /> The Board determined that the use is in harmony with the general <br /> purpose and intent of the Zoning By-laws and complies with the <br /> provisions therein. The Board found that the extension, alteration or <br /> h{ <br /> change would not be substantially more detrimental to the neighborhood <br /> than the existing nonconforming use. <br />
