BOX 1106 <br /> f MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of Everett Hatt for a Special Permit SP-89-10-102 <br /> A Petition was filed by Everett Hatt of Forestdale, Massachusetts <br /> for a Special Permit for permission to expand a non-conforming <br /> structure in an R-5 zoning district on property located at 10 Pine <br /> l Grove Circle (Map 1, Block 23) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on November 27 and December 4, 1989, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, December 13, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William J. Hanrahan, Richard E. Halpern and John J. Friel. <br /> Mr. Bruce Murphy represented the applicant. He presented plans <br /> for the conversion of a seasonal cottage to a year round home and <br /> explained that the property is located half in Mashpee and half in <br /> Sandwich. The existing home is to be moved and will result in a <br /> minimum front setback of 14' . There were no comments from abutters. <br /> The Board determined that the use is in harmony with other <br /> permitted uses in this zoning district and complies with the <br /> provisions of the Zoning By-laws. The Board found that the extension <br /> or change shall not be substantially more detrimental to the neighborhood <br /> than the existing non-conforming use. <br />
