BOX 1106 <br /> rAB MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of Walter Hay for a Special Permit SP-89-11-107 <br /> A Petition was filed by Walter Hay Jr. of Mashpee, Massachusetts <br /> for a Special Permit under Sections 5. 1 and 6.3.I.9 of the Zoning <br /> By-laws for permission to repair and maintain a dock in Little River on <br /> property located in an R-3 zoning district on a private road located <br /> off of Seconsett Point Road (Map 124, Block 25) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. .Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on December 11 and December 18, 1989, a copy of which is a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, December 27, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Edward M. Govoni and John J. Friel. <br /> Jack Landers-Cauley of Benchmark Engineering represented the <br /> applicant. He presented plans to the Board for the removal of an <br /> existing wood dock and construction of new dock and walkway and <br /> repair of bulkhead. He explained that a pier had existed on the <br /> property since 1955. <br /> Comments were received from the Shellfish Constable stating his <br /> opinion that the proposed structure would not cause disruption of the <br /> marine environment. No comments were received from abutters. <br /> The Board determined that the use is in harmony with the general <br /> purpose and intent of the Zoning By-laws and complies with the <br /> provisions thereof. <br />
