BOARD OF APPEALS David W. and Diana L. Damon SP-89-11-108 Page 2. <br /> Paul Somerville, Shellfish Constable, stated that he had not <br /> received the shellfish survey prepared by Sabatia. He informed <br /> the Board that this area of Great River is a productive resource <br /> area. He stated that there are several other structures of similar <br /> design in the immediate area. He explained that seasonal floating <br /> docks present potential problems by limiting access to shellfish <br /> under the float and the possibility of damage to the shellfish <br /> beds from vessels grounding out. <br /> Robert Sherman, Conservation Agent, stated that he considered <br /> the construction and use of the dock would cause substantial <br /> disruption to the shellfish habitat. <br /> The Board of Appeals, after carefully considering all of the <br /> facts and evidence submitted at the hearing, makes the following <br /> findings: <br /> 1. The Board determined that the petitioner failed to meet <br /> the conditions necessary for the granting of a Special Permit. <br /> 2. There was not sufficient evidence that the use is in harmony <br /> with the general purpose and intent of the zoning by-laws. <br /> 3. There was not sufficient evidence that the use complies <br /> with the general or specific provisions set forth within <br /> the zoning by-laws. <br /> Upon motion duly made and seconded, the Board of Appeals <br /> voted unanimously on December 27, 1989 to deny the petition <br /> without prejudice. <br /> �. b . . r • <br /> r� � •ti - Q w <br /> JAN 1 1t 1990 <br />
