MA 02649 BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT RE: Petition of David McMenamy for a Special Permit SP-89-08-82 A Petition was filed by David McMenamy of North Falmouth, Massachusetts for a Special Permit to extend a non-conforming use to allow for the replacement of a summer residence with a year-round home in an R-3 zoning district on property located at 129 Shore Drive (Map 117, Block 91) Mashpee, Massachusetts (Owners of record: Louis and E. Lorraine McMenamy) . Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee on September 11 and September 18, 1989, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the petition at the Mashpee Town Hall on Wednesday, September 27, 1989 at which time the following members of the Board of Appeals were present and acting throughout: Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. Joseph Harvey represented the applicant. He presented plans to the Board for a new home to be built on the exact footprint of a seasonal cottage which will be demolished. He informed the Board that existing concrete block slab will be replaced with a concrete foundation and a new septic system will be installed. The grading on the lot will not be changed. No comments were received from abutters. The Board determined that the use is in harmony with other permitted uses in this zoning district and a change or extension would not be substantially more detrimental than the existing conditions. The Board established that granting this Special Permit would be in harmony with the general purpose and intent of the by-laws and would not be a detriment to the neighborhood.
