MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> RE: Petition of David McMenamy for a Special Permit SP-89-08-82 <br /> A Petition was filed by David McMenamy of North Falmouth, Massachusetts <br /> for a Special Permit to extend a non-conforming use to allow for the <br /> replacement of a summer residence with a year-round home in an R-3 <br /> zoning district on property located at 129 Shore Drive (Map 117, Block 91) <br /> Mashpee, Massachusetts (Owners of record: Louis and E. Lorraine McMenamy) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on September 11 and September 18, 1989, a copy of which is attached <br /> hereto and made a part hereof. <br /> A Public Hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, September 27, 1989 at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Joseph Harvey represented the applicant. He presented plans to <br /> the Board for a new home to be built on the exact footprint of a <br /> seasonal cottage which will be demolished. He informed the Board that <br /> existing concrete block slab will be replaced with a concrete <br /> foundation and a new septic system will be installed. The grading on <br /> the lot will not be changed. No comments were received from abutters. <br /> The Board determined that the use is in harmony with other permitted <br /> uses in this zoning district and a change or extension would not be <br /> substantially more detrimental than the existing conditions. <br /> The Board established that granting this Special Permit would <br /> be in harmony with the general purpose and intent of the by-laws and <br /> would not be a detriment to the neighborhood. <br />
