P. 0. BOX 1106 <br /> f MASHPEE. MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Paul E. and Ann T. Keon for a Special Permit SP-89-08-81 <br /> A Petition was filed by Paul E. and Ann T. Keon for a Special Permit <br /> for permission to build a fixed pier in an R-3 zoning district on <br /> property located at 136 Captain's Row (Map 96, Block 22) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on September 25, 1989 and October 2, 1989. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, October 11, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and Richard E. Halpern. <br /> George Thorng of Arrow Engineering represented the applicant. <br /> He presented plans for the replacement of an existing dock with a <br /> walkway and 6' x 30' fixed pier. Comments were received from the <br /> Shellfish Commission requesting that boating activity be restricted <br /> to the three outer sides of the float. Paul Somerville, Shellfish <br /> Constable, stated that securing vessels along the pier section could <br /> result in disruption and possible destruction of the shellfish resources. <br /> No comments were received from abutters. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on. October 11, , 1989 to grant the Special Permit per <br /> Arrow Engineering Plan dated July 14, 1989 with the following condition: <br />
