T P. 0. BOX 1108 rA$ MASHPEE. MA 02649 BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT A Petition was filed by James R. and Marilyn A. Walker for a Special Permit for permission to build a fixed pier in an R-3 zoning district on property located at 184 Captain's Row (Map 96, Block 32) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 25, 1989 and October 2, 1989. A public hearing was held on the Petition at the Mashpee Town Hall on Wednesday, October 11, 1989 at 7:30 p.m. at which time the following members of the Board of Appeals were present and acting throughout: Cheryl A. Hawver, Michael A. Makunas and Edward M. Govoni. George Thorng of Arrow Engineering represented the applicant. He presented plans to the board for the construction of a walkway and a 6' _x 30' fixed pier in the Mashpee River. Comments were received from the Shellfish Commission requesting that boat dockage be restricted to the outer edges of the fixed pier. No comments were received from abutters. Upon motion duly made and seconded the Board of Appeals voted unanimously on October 11, 1989 to grant the Special Permit based on Arrow Engineering Plan B-253 dated July 14, 1989 with the following condition: 1. all boat dockage shall be limited to the outer edges of the 6' x 30' t-section of the structure. The Board established that granting this Special Permit would be in harmony with the general purpose and intent of the by-laws and would not be a detriment to the surrounding neighborhood.
