1 <br /> P. O. BOX 1108 <br /> r9B MASHPEE. MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Robert L. Gauthier for a Special Permit SP-89-09-86 <br /> A Petition was filed by Robert L. Gauthier of Mashpee, Massachusetts <br /> for a Special Permit for permission to expand a non-conforming structure <br /> in an R-3 zoning district on property located at 9 Samoset Road (Map 125, <br /> Block 70) Mashpee, MA'. (Owner of record: Robert L. and Eileen M. <br /> Gauthier) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on September 25 and October 2, 1989, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, October 11, 1989 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br /> Mr. Gauthier presented plans to the Board for an 8' 1" x 16' greenhouse <br /> addition to the second-floor master bedroom. The addition would be <br /> supported by sonar tubes and be located over an existing bulkhead. <br /> No comments were received from abutters. <br /> The Board determined that the use is in harmony with other permitted <br /> uses in this zoning district and a change or extension would not be <br /> substantially more detrimental than the existing condition. The Board <br /> established that granting this Special Permit would not derogate from <br /> the intent of the By-laws and would not be a detriment to the surrounding <br /> neighborhood. <br />
