MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of Suzanne Nash for a Variance V-89-09-87 <br /> A Petition was filed by Suzanne Nash of Canton, Massachusetts for <br /> a Variance from Section 7.7 of the Land Space Requirements for permission <br /> to build a house addition and new deck within 50 feet of Santuit Pond in <br /> an R-5 zoning district on property located at 57 Timberland Drive <br /> (Map 29, Block 33C) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 9 and 16, 1989, a copy of which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, October 25, 1989 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, William J. Hanrahan and Michael A. Makunas. <br /> Mr. George Thorng of Arrow Engineering represented the applicant. <br /> He presented plans for an addition and deck to be built within 50 feet <br /> of Santuit Pond. The buildings on the lot presently result in 8.67 <br /> lot coverage and with the proposed additions lot coverage would be 16.97. <br /> Comments were received from the Conservation Commission concerning the <br /> septic system plans. The Board determined that the Title V concerns were <br /> not within the authority of the Board of Appeals and would be under the <br /> jurisdiction of the Board of Health. No comments were received from <br /> abutters. <br /> The Board found that the topography of the lot created a hardship <br /> and that this Variance request would not derogate from the intent of <br /> the By-laws and would not be a detriment to the surrounding neighborhood. <br />
