Hennessey V-90-21 <br /> A Petition was filed by William F. Hennessey of Somerville, <br /> Massachusetts for a Variance under Section 174-31 of the Zoning By-laws <br /> for permission to vary the set-back requirements to allow for the <br /> construction of a garage in an R-5 zoning district on property <br /> located at 17 Fox Hill Road (Map 21, Block 74) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of <br /> Mashpee on February 26, 1990 and March 5, 1990, a copy of which <br /> is attached hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 14, 1990 at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br /> Mr. Hennessey informed the Board that he proposed to build a <br /> garage at the side of his property abutting common land. The <br /> placement of the garage was in line with an existing drive. <br /> A direct abutter to the common land spoke in favor of the Petition. <br /> The Board determined that due to the topography of the lot <br /> which especially affect the land in question but which do not affect <br /> the zoning district in which the land is located that a literal <br /> enforcement of the By-laws would create a hardship. The Board <br /> found that desireable relief could be granted without detriment to <br /> the public good and without derogating from the intent of the By-laws. <br />
