LaBrecque for a Special Permit SP-90-08
A Petition was filed by Francis J. Labrecque of Dover, Massachusetts
for a Special Permit under Sections 174-17 and 174-33 of the Zoning By-laws
for permission to reconstruct and expand a non-conforming structure in an
R-3 zoning district on property located at 8 Capstan Circle (Map 111,
Block 99) Mashpee, Massachusetts (Owner of record: Francis J. and
Lori S. LaBrecque) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on February 28 and March 7, 1990, a copy of which is attached hereto and
made a part hereof.
A public hearing was held on the Petition at the Mashpee Town Hall
on Wednesday, March 14, 1990 at 7:30 p.m. at which time the following
members of the Board of Appeals were present and acting throughout:
Cheryl A. Hawver, Michael A. Makunas and John J. Friel.
Attorney Kevin Kirrane represented the applicant. He informed the
Board that the owner wishes to reconstruct a 20-year old structure,
add a second floor, screened-in porch and wood deck. The property is
located within 50 feet of wetlands and the owner has received an Order
of Conditions from the Conservation Commission. Mr. Kirrane explained
that the proposed. reconstruction would result in 21.57 lot coverage
but owner is willing to revise plans to conform with the 207 lot
coverage stipulated in the Zoning By-laws.
The Board determined that the use is in harmony with the general purpose
and intent of the Zoning By-laws and complies with the provisions set
forth. within the By-laws. The Board found that the change or extension
would not be a detriment to the neighborhood.
