LaBrecque for a Special Permit SP-90-08 <br /> A Petition was filed by Francis J. Labrecque of Dover, Massachusetts <br /> for a Special Permit under Sections 174-17 and 174-33 of the Zoning By-laws <br /> for permission to reconstruct and expand a non-conforming structure in an <br /> R-3 zoning district on property located at 8 Capstan Circle (Map 111, <br /> Block 99) Mashpee, Massachusetts (Owner of record: Francis J. and <br /> Lori S. LaBrecque) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 28 and March 7, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, March 14, 1990 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br /> Attorney Kevin Kirrane represented the applicant. He informed the <br /> Board that the owner wishes to reconstruct a 20-year old structure, <br /> add a second floor, screened-in porch and wood deck. The property is <br /> located within 50 feet of wetlands and the owner has received an Order <br /> of Conditions from the Conservation Commission. Mr. Kirrane explained <br /> that the proposed. reconstruction would result in 21.57 lot coverage <br /> but owner is willing to revise plans to conform with the 207 lot <br /> coverage stipulated in the Zoning By-laws. <br /> The Board determined that the use is in harmony with the general purpose <br /> and intent of the Zoning By-laws and complies with the provisions set <br /> forth. within the By-laws. The Board found that the change or extension <br /> would not be a detriment to the neighborhood. <br />
