MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Application of Raymond C. Lopes for a Variance V-90-30 <br /> A Petition was filed by Raymond C. and Gail S. Lopes of Mashpee, <br /> Massachusetts for a Variance under Section 174-31 of the Zoning <br /> By-laws for permission to vary the setback requirements in an R-5 <br /> zoning district on property located at 156 Hooppole Road (Map 57, <br /> Block 24) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chaper 40A. Notice was given by publication <br /> in The Enterprise, a newspaper of general circulation in the Town of <br /> Mashpee on March 12 and March 19, 1990, a copy of which .is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 28, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, John J. Friel and Richard E. Halpern. <br /> Mrs. Lopes presented plans for a 20' x 34' bedroom addition. <br /> She explained that due to the topography of the lot and the location <br /> of the well and septic system the addition could only be placed on <br /> the south westerly lot side. Letters were .received from three <br /> abutters in favor of the Petition. <br /> The Board found that this Variance request would not derogate from <br /> the intent of the By-laws and would not be a detriment to the surrounding <br /> neighborhood. The Board determined that there were circumstances relating <br /> to the topography of the lot which especially affected the lot in question <br /> but did not affect generally the zoning district in which the land is <br /> located and that a literal enforcement of the By-laws would create a <br /> hardship. <br />
