Tucci for a Special Permit SP-90-38 <br /> A Petition was filed by Donald J. Tucci of East Weymouth, <br /> Massachusetts for a Special Permit under Section 174-17 of the Zoning <br /> By-laws for permission to change a non-conforming structure with the <br /> replacement of the foundation on a seasonal home in an R-5 zoning <br /> district on property located at 17 Park Road (Map 1, Block 14) <br /> Mashpee, Massachusetts. (Owner of record: Donald J. and Joan C. Tucci) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on March 12 and March 19, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, March 28, 1990 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Mr. Tucci informed the Board that he wished to place a full <br /> foundation under a seasonal home. . The floor plan would not be <br /> enlarged. No comments were received from abutters. <br /> The Board determined that the use is in harmony with other permitted <br /> uses in this zoning district and the change would not be a detriment to <br /> the neighborhood. The Board established that granting this Speical <br /> Permit would not derogate from the intent of the By-laws. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on March 28, 1990 to grant the Special Permit as <br /> requested. The permit is referenced by Doyle Engineering plans <br /> dated February 21, 1990. <br /> I <br />
