McGinnis for a Variance V-90-36 <br /> A Petition was filed by Robert P. McGinnis of East Walpole, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> for permission to vary the setback requirements in an R-3 zoning district <br /> on property located at 11 Pembroke Drive (Map 123, Block 58) Mashpee, <br /> Massachusetts. (Owner of record: John T. and Linda T. Curran) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on March 26 and April 2, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, April 11, 1990 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and Richard E. Halpern. <br /> Mr. McGinnis represented his application and presented plans for <br /> his existing dwelling and a proposed deck addition. He explained that <br /> the roof line of the house extends Vin the front and he plans to have <br /> a farmer's porch under this roof extension which would lead to a deck <br /> at the side of the house. There were no comments from abutters. <br /> The Board determined that the location of the lot on the corner <br /> of Uncatena Road and Pembroke Drive created a hardship in meeting the <br /> front setback requirements from both streets. The Board found that <br /> desirable relief could be granted without derogating from the intent <br /> of the By-laws,and that granting this Variance.request would not be <br /> a detriment to the surrounding neighborhood. <br />� �I <br />
