Lindsley for a Special Permit SP-90-39 <br /> A Petition was filed by James J. Lindsley of Cotuit, Massachusetts <br /> for a Special Permit under Section 174-25.F.2 of the Zoning By-laws <br /> for permission to operate a used vehicle sales office in a C-2 zoning <br /> district on property located at 22 Falmouth Road (Route 28) (Map 55, <br /> Block 8) Mashpee, Massachusetts. (Owner of record: Merry Meadow <br /> Enterprises Inc.) . <br /> .Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on March 26 and April 2, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, April 11, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and Edward M. Govoni. <br /> Mr. Lindsley represented his application. He informed the Board <br /> that he proposed to use one office in Building 1 for a sales office <br /> for used cars. He presented plans for four parking spaces on the <br /> property to be used for cars for sale. He explained that most of his <br /> business .was dealer-to-dealer and he did not anticipate many direct <br /> customers would be visiting the site. Mr. Robert McNutt, owner of the <br /> property, spoke in favor of the application. <br /> The Board found that the plans did not meet the zoning requirements <br /> on the required number and dimensions of parking spaces. The Board did <br /> not find that the granting of this Special Permit would be in harmony <br /> with the purpose and intent of the Zoning By-laws or complied with the <br /> provisions thereof. <br />
